Acquisition of Wind Farm Easements
Although power generated by wind turbines is not a new technology, there is now a growing demand for this means of generating electric power.
Uniquely, the nature of determining appropriate locations for wind farms typically requires the acquisition of temporary easements along with options for permanent easements. Testing equipment must first be placed on prospective sites for periods of up to three years to identify wind patterns in order to establish meteorological feasibility. The duel task of obtaining land rights for the testing phase and obtaining options for actual placement of wind turbines at a later date requires the best of negotiating skills. An additional challenge for negotiators is the “open season” competition between and among wind power companies that may result in two or more companies vying for the same ground and presenting counter-offers to the same landowners.
